The purpose and legal basis for processing your data

Here at Unicorn we only collect the data of parties who have consented to receive information from us using a double opt in process. We clearly state what actions you can expect from adding your details to our database at the point of data entry. Consent is obtained using clear information consisting of simple language which informs the client of all processing conditions.

The data subject is made aware of the specific processing details, the type of information collected and the purpose of the processing of data.

At any time you can request for your data to be deleted and your details will be removed and deleted from our database and you will receive no more contact from Unicorn.

We only ever collect personal data because the data subject has requested us to do so and in doing so has allowed us to make contact with them and inform them about the services and content that Unicorn has to offer.

We do not collect sensitive private data like criminal or health records about the data subject at any time.

We treat all data subjects fairly and do not provide any misleading information which might convince them to share their data with Unicorn under duress.

The legitimate interests of the controller

Here at Unicorn we process information and data for the legitimate interests of the data subject who has consented to share their data with us and we will never pass on that data to a third party.

We only collect data for our own records. We never process data which is unwarranted and only collect data which has been clearly sanctioned by the data subject in question.

We only send out information which is relevant to Unicorn and where the data subject has agreed to receive this information.

Our data processing is fair and lawful and complies with all the data protection principles laid out in the GDPR.

Any recipient or categories of recipients of the personal data

At Unicorn we do not share the data we collect with third parties, we collect data solely for our own use. However we may share the information we have collected with our employees and freelancers who will use the information solely for Unicorn’s purpose. All data will remain encrypted and all staff are trained in the GDPR regulations and Unicorn’s privacy notice to make sure our data processing is fair and lawful and complies with all the data protection principles laid out in the GDPR.

Details of transfers to third party and safeguards

We never share your details with a third party. Your data is being collected purely for our use and our own records.

The data subject’s details are encrypted to keep it safe, any system or product which contains data is encrypted. We systematically monitor our data to make sure it is kept secure. We have comprehensive procedures in place to detect, report and investigate personal data breaches and will always inform the ICO if an individual’s details have been taken and the stolen information is likely to cause damage of some kind.

Retention period or criteria used to determine the retention period

We will not retain personal data for any longer than is necessary or when it is no longer suitable for the purpose the information was obtained for. We regularly review our data and securely delete inaccurate, out of date and irrelevant sources. Information that we hold which does not need to be accessed regularly, but which still needs to be retained, is safely encrypted and archived or put offline. We typically retain records for as long as the processing to which it relates continues, unless consent is retracted. If consent is retracted the personal data will be deleted within 1 week and all personal details will be removed from our database.

The existence of each of data subject’s rights

We will only ever collect your details and contact you when you have given us clear permission to do so. We will make you aware how your information is processed, the purpose for which it is processed and the information that we collect and keep in our database. The data subject has the right at any time to request for their information to be removed and deleted from our database which we will ensure is done quickly (within one week). Your given consent is at all times revocable.

If the data subject feels that Unicorn is mistreating their data they can raise a complaint with the ICO.

The data subject can request subject access at any time. This includes confirmation that their data is being processed, access to their own personal information we have in our records and any other supplementary information. We will provide this information when requested within one month of receiving the request. If the information requested is particularly complex we will extend this time to a further 2 months, but we will always inform you if this is the case within the first month after the request is made and explain why the extension is necessary. If a request is made repeatedly or excessively we reserve the right to charge for this service which will be based on the administration costs entailed in retrieving the information or in extreme circumstances refuse to respond. We will explain our reason for refusal and will advise that you can complain to the ICO and advise that you should do so within one month of our refusal. When an information request is made we will use reasonable means to verify the identity of the person making the request. We will try to respond to a request for information in the format the customer contacted us initially, for example, by email or phone.

The right to withdraw consent at any time.

You have the right to withdraw consent for the use of your data at any time. If you wish for us to remove your data from our database please contact us at the details above or email us at hello@madebyunicorn.com and tell us you would like to unsubscribe and we will remove and delete your details from our database.

We also delete data that is no longer accurate or if it is unnecessary for the purpose it was originally collected to make sure our database holds accurate and up to date information.

The right to lodge a complaint with a supervisory authority

As with all data collection if you feel that Unicorn is mistreating your data and not handling it in a manner that you see fit, you can lodge a complaint with the ICO. The ICO will then keep the complainant (you) involved in the process and outcome regarding your complaint.

Whether the provision of personal data is part of a statutory or contractual requirement or obligation and possible consequences of failing to provide the personal data

There is absolutely no contractual requirement to provide Unicorn with your personal details. You are in no way obliged to provide your details and we make that clear at the point when you enter your details to share them with us. There will be no consequences for failing to share your data with Unicorn although you will not receive the information that you would have concerning our services if you had shared your data with us.

The existence of automated decision making, including profiling and information about how decisions are made, the significance and the consequences.

Our data processing at Unicorn does not include any automated decision making or profiling without any human intervention.
